The rationale behind the enactment of Consumer Protection Act of 1986 is to protect the consumer against unethical and unfair trade practices. Also, it recognises the consumer’s right to be informed, right to choose, right to seek redressal and right to represent himself/herself in consumer courts.

Duplicate articles and adulteration causes the different losses to consumers. The main loss related to money. The consumer is actually paying for a quality product while in reality he gets the inferior products . adulterated product are originally  cheap while it  is sell in high prices.

One of the main loss is regarding health. Sometimes the adulterated product may contain the health hazard like the adulterated juice/drink or any food related product may contain the dangerous material with it which upon eating can cause the serious health issue and diseases.

The Rules and regulations are required for the protection of the consumers in the market for the following reasons
(i) To check adulterations At times greedy traders try to play with the health of consumers by indulging in adulteration of edible oils, milk, butter, ghee etc.
(ii) To check powerful producer Markets do not work in a fair manner if there is monopoly of few and powerful producers and when purchase of consumer is small and they have no single voice. So there is need of rules and regulations in the market.
(iii) False information Most of the time the false information is passed to consumers through media and other sources to attract the consumers.

The legal measures taken by the government to empower the consumers in India were
(i) The MRTP Act was enacted in 1984, to check unfair trade practices by manufacturers and service providers.
(ii) The Consumer Protection Act (COPRA) was enacted in 1986, to protect consumers from exploitation in the marketplace.
(iii) Subsequently, Consumer Courts have been set up to provide justice to consumers who have been treated unfairly in the marketplace.

Consumer do not seek redressal becoming the process is cumbersome, expensive and time consuming.
A Redressal case requires …
(a) engaging a lawyer.
(b) filing and attending the court proceedings.
(c) the non availability of cash memos as cash memos are not issued for most purchases.
(d) evidence is not easy to gather.
(e) most purchases in the market are small retail sales.
(f) the existing laws also are not very clear on the issue of compensation to consumers.
(g) injured by defective products.

In India, consumer movement originated as a social force. Three factors that gave rise to consumer movement in India are as listed below:

  1. Necessity of protecting consumers against unethical practices of traders and shopkeepers.
  2. Frequent shortages of food, hoarding and black marketing, which led to inflation.
  3. Adulteration of food which may lead to several health hazards.

 Midddle class: After feudalism came to an end in Europe, a new class of men came to the forefront of the society , the middle class.They were the trading class, the mercantile and the business class and the professionals.
